End User License Agreement

2. Relationship to other terms

This EULA applies to desktop software installation and use. Account, service, purchase, privacy, and refund matters are also governed by the Terms of Service, Purchase and Order Terms, Privacy Policy, and Refund & Cancellation Policy.

3. Subscription entitlement limits

Your use of the PCCX™ Labs desktop application is limited to the users, seats, machines, features, usage scope, support scope, and other entitlements of your active Free, Pro, or Enterprise subscription tier or written order.

If a subscription expires, is cancelled, is refunded, is not paid, or is terminated, the license ends automatically except for any rights that must survive under applicable law or a separate written agreement.

4. Restrictions

• You must not reverse engineer, decompile, disassemble, or attempt to derive source code or underlying ideas from the software, except to the extent applicable law forbids restricting those activities.
• You must not redistribute, resell, rent, lease, lend, sublicense, publish, host, or provide the software as a service to third parties unless 알티피전스(Altifigence) agrees in writing.
• You must not remove, obscure, or alter copyright, license, trademark, proprietary, attribution, or notice information.
• You must not bypass licensing, entitlement, access-control, metering, security, or technical restriction mechanisms.
• You must not use the software outside the scope of your active subscription tier, written order, or separate written agreement.

5. Ownership

The PCCX™ Labs desktop application, software, documentation, user interface, service design, trademarks, and all related IP rights remain owned by 알티피전스(Altifigence) or its licensors. This EULA grants only a limited license to use the software. No ownership interest is transferred.

6. Open-source components

The software may include open-source components. Open-source components remain licensed under their own license terms. If an open-source license grants rights that are broader than this EULA for that component, that open-source license controls for that component only.

7. Software updates

알티피전스(Altifigence) may provide updates, patches, fixes, feature changes, compatibility changes, or security updates. Updates may be required to continue using PCCX™ Labs or to maintain compatibility with hosted services or entitlement checks.

8. Data and customer materials

You are responsible for backing up your own files, source trees, reports, logs, and customer materials. PCCX™ Labs may process customer-provided files or logs only as needed to provide the licensed functionality, support, diagnostics, or review workflow described in the applicable plan or written order.

9. Warranty disclaimer

The PCCX™ Labs desktop application is provided "AS IS" and "AS AVAILABLE" except where a separate written agreement states otherwise. 알티피전스(Altifigence) disclaims implied warranties to the maximum extent permitted by applicable law, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

10. Limitation of liability

To the maximum extent permitted by applicable law, 알티피전스(Altifigence) is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, business interruption, loss of goodwill, procurement of substitute software, or engineering schedule impact.

To the maximum extent permitted by applicable law, the aggregate liability of 알티피전스(Altifigence) for claims relating to the PCCX™ Labs desktop application is limited to the amount paid by you for PCCX™ Labs during the three months before the event giving rise to the claim. For Free tier use, the aggregate liability is limited to KRW 100,000.

11. Termination

This EULA terminates automatically when your subscription ends, expires, is cancelled, is refunded, is not paid, or is terminated. 알티피전스(Altifigence) may also terminate this EULA if you breach it. Upon termination, you must stop using the software and uninstall or delete copies under your control unless retention is required by law.

12. Export-control compliance

You must comply with applicable export-control, sanctions, and trade-compliance laws and must not use, export, re-export, or transfer PCCX™ Labs in violation of those laws.

13. Governing law

This EULA is governed by the laws of the Republic of Korea, without regard to conflict-of-law rules.
